Arrested as a Civilian

As a U.S. Marine, you may assume a different set of rules apply to you – and they do -- but when members of the military are off-base or off-post, they can still be arrested as civilians. This means that the booking, holding, bail, and trial process will be the same, with the added exception that members of the military will be expected to inform their commanding officer of the arrest.

Setting Your Bail

Following a civilian arrest, you will be taken to the local police department. This will depend largely on where you are arrested. The closest city to Camp Pendleton is Fallbrook, which is served by the San Diego Sheriff’s department. If you are arrested there, then you will probably be taken to 388 E. Alvarado St., Fallbrook, CA 92028. There you will go through the booking process, where your picture will be taken, your fingerprints recorded, and your criminal record updated.

Within 24-28 hours of your arrest, you will be granted a bail hearing. This hearing will determine whether or not you are granted bail. As a member of the military, especially one stationed at nearby Camp Pendleton, chances are high that bail will be granted as you will be deemed “not a flight risk” or a risk to the community. However, whether or not you are released will depend on if you actually post bail.

If you do not post bail, then you will be held in jail or transferred back to the camp and kept in confinement there until your trial ends. This process could take weeks, or even months, to conclude. Meanwhile, you will be missing important time with your family, and your reputation and your rank could be severely damaged by the arrest.
